Terms and Conditions of Sale and Use

These general terms and conditions of sale are the only applicable ones and supersede all other conditions, unless previously, expressly, and in writing waived. FOLIOVE may occasionally need to modify some of the provisions of its general conditions, so it is necessary that these be re-read before each visit to the Foliove.com site (hereinafter referred to as the "Site"). Each purchase on the Site is governed by the general conditions applicable on the date of the order. By validating your order, you unreservedly accept the current General Conditions after having read them. By accessing the Foliove.com Site, you agree to comply with these conditions.

To use the Site, you must be at least 18 years old, be legally capable of entering into contracts, and use this Site in accordance with these General Terms and Conditions of Sale and Use. You guarantee the truthfulness and accuracy of the information you provide on this Site.
FOLIOVE reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

1. Essential product characteristics

The products sold on the Site are certified prints, postcard sets, or any other product created, designed, and offered by FOLIOVE. These artistic creations are the expression of the author's creativity, Marie Troff. All illustrations are ©Foliove. It is strictly forbidden to copy them for commercial purposes.
Product prices are indicated in euros, excluding the buyer's contribution to processing and shipping costs. If you order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable.
These duties and sums are not the responsibility of FOLIOVE. They will be at your expense and are your sole responsibility, both in terms of declarations and payment to the competent authorities and/or bodies in your country. It is essential to inquire about these specific aspects with the competent authorities beforehand.
FOLIOVE reserves the right to modify its prices at any time. Products will be invoiced on the basis of the prices in force at the time of order registration, subject to availability.
Products remain the property of FOLIOVE until full payment of the indicated price.

2. Placing an order

To place an order, you must at least go through the following steps:

1. Consultation of the product sheet. You must click on "Add to cart" to add this item to your cart.
2. "Cart" screen: you can view the list of selected creations and delete an item or modify the ordered quantities at any time.
3. Identification or customer account creation screens.
4. Delivery method selection screen. On this screen, a link is provided to modify the items in your order.
5. Summary and payment choice screen. This screen allows you to choose your payment method and check the various elements of your order (items, quantities, delivery method, total price). You must ensure that all these elements comply with your request. Using the links on this screen, you can modify your order.
6. You must then accept these general terms and conditions of sale and use of the Site to proceed to the payment step. The conditions are available for reading and printing from the link titled "general terms and conditions of sale". Their acceptance is done by checking the box next to the proposed link. The general terms and conditions of sale and use of the Site must be accepted with each order.
7. You pay for your order using the chosen payment method from those indicated.
8. The contract is concluded only upon confirmation of payment by the bank.
9. The Site sends you an automatic order confirmation to your email address.

3. Price and payment security

Prices indicated on FOLIOVE.COM are expressed in euros. Payment for your purchases is made by bank card: Visa, Mastercard via Paypal. Secure online payment by bank card is fully secure. It is carried out via Paypal Inc.
Bank information is not communicated to us. All personal data essential for processing orders is encrypted. In this way, it is impossible to read during transfer over the Internet. For any other payment method, please contact FOLIOVE.

4. Proof

The data recorded by the Site constitutes proof of all transactions carried out between the Site and its customers.
The data recorded by the bank's payment system constitutes the sole and exclusive admissible proof of financial transactions carried out.

5. Order processing and delivery

Orders placed from Monday to Friday, excluding public holidays, are dispatched within 24 hours, subject to manufacturing times for certain products. Works marked "OUT OF STOCK" can no longer be ordered.

6. Delivery address

FOLIOVE delivers to mainland France, European Union countries, and all countries served by the Colissimo carrier.
Products are delivered to the delivery address you indicate during the ordering process, which may be different from the billing address. The delivery deadline is dependent on and corresponds to:
- the shipping time indicated on the product sheet, to which must be added
- the processing and transit time.

Changing the delivery address after placing the order is generally no longer possible for logistical reasons.
However, you can contact us by email or phone if you wish to change the delivery address, and we will then examine the possibilities offered depending on your order.

7. Delivery methods and times

Available delivery methods depend on the quantity, size of the item(s) ordered, and the delivery country.
If your order includes items of different sizes, the size of the largest item is taken into account. FOLIOVE reserves the right to choose the carrier. Compliance with delivery times depends on the carrier. Consequently, no request for compensation, of any kind whatsoever, may be invoked or claimed by the customer.

8. Shipping costs

Shipping costs vary depending on the country and delivery method, as well as the number and format of the works ordered.

9. Receipt of delivery

Upon receipt of your order, it is your responsibility to open the package to check the good condition of the prints. If you do not personally receive the package, ask the person in charge of receiving the package to perform this verification.
In case of a problem, please return your package to the delivery person (La Poste or private carrier) specifying the problem encountered and contact our customer service the same day.
Do not sign the delivery note if the order arrived damaged. No claim will be admissible if the delivery note has been signed.
In the case of delivery by a private carrier, the carrier is not obliged to deliver inside your home and may hand over the package at the entrance to your building or house.
The receipt of transported goods extinguishes any action against the carrier for damage or partial loss if, within three days, excluding public holidays, following that of such receipt, the consignee has not notified the carrier, by extrajudicial act or by registered letter, his protest, which must be motivated. (Article L 133.3 of the Commercial Code).

10. Right of withdrawal

In accordance with current legal provisions, as a private individual, you have a general right of withdrawal to return the work that does not suit you. This right does not apply to orders placed by companies.
For any order on the Site, you have a period of 7 days from the effective placement of the order to exercise your right of withdrawal with FOLIOVE, without having to provide any reason or pay any penalty.
To do this, please contact our customer service, who will provide you with the return address, and you will then have a period of 10 days to return your order in its original packaging.
- If your order was delivered by La Poste (Colissimo), you can return your order by La Poste (return shipping costs at your expense).
- If your order was delivered by a carrier, they will pick up your order. This service will be charged at the same price as the initial delivery costs.
No cash on delivery shipment will be accepted, for any reason whatsoever.
FOLIOVE will refund the price of the returned items as well as the initial shipping costs minus penalties (return costs remain at your expense) within 15 days of receipt by them, by credit to the bank account used for payment, or by bank check or gift voucher depending on the payment method used at the time of the order.

11. Right of return

In the event that the received works do not conform to the order, you have a right of return. In this case, please contact Marie Troff who will provide you with the return address and procedures. FOLIOVE will exchange the damaged item, within the limits of available stock. In the case of exercising the right of return and only in this case, the return and new shipping costs remain at the expense of FOLIOVE.

12. Customer service and complaints

For any information or questions, customer service is available from Monday to Friday, from 9:30 a.m. to 1:00 p.m. and from 2:00 p.m. to 6:00 p.m., (from France) 07 83 67 32 37 to provide you with any information you may require about my illustrations and your order.

In application of Article 1148 of the Civil Code, FOLIOVE cannot be held responsible or considered to have committed a fault in the processing of your case, if any delay or non-performance results from a case of force majeure.

The automated processing of personal information has been declared to the National Commission for Data Protection and Liberties under number 1280165. The information and data concerning you, necessary for the management of your order and our commercial relations, may be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders, for their management, execution, processing, and payment.
This information and data are also kept for security purposes, to comply with legal and regulatory obligations, and to enable us to personalize the services we offer you and improve the quality of the information we send you.

In application of the Data Protection Act of January 6, 1978, you have a right to access, modify, rectify, and delete data concerning you. The products offered comply with current French legislation.
FOLIOVE strives to ensure, to the best of its ability, the accuracy and updating of the information disseminated on this site, the content of which it reserves the right to correct, at any time and without notice.

Consequently, FOLIOVE disclaims all responsibility for any interruption of the site, any occurrence of bugs, any inaccuracy or omission concerning information available on the site, any hacking or any damage resulting from fraudulent intrusion by a third party resulting in a modification of the information made available on the site.

This site may contain links to other sites. FOLIOVE cannot be held responsible for access problems or content on these sites. FOLIOVE will not be responsible for damages resulting from the use or inability to use the Site. FOLIOVE undertakes to respect all legal guarantees that you may claim.

The works presented on my site comply with the provisions of French law, I cannot be held responsible for the violation of the legislation specific to the country of delivery of the work. Rights to the work

The artist (Marie Troff), having taken the initiative for her creation, retains the copyright on her creation, within the meaning of French law. The rights of representation and reproduction of the works present on the Foliove.com site belong to their author and are registered under Copyright FOLIOVE.
My authorization is necessary for any exploitation of these rights.
As such, and in accordance with the provisions of the intellectual property code, only use for private purposes, subject to different or more restrictive provisions of the intellectual property code, is authorized.

Intellectual property rights

All elements present on the site and the site itself are strictly reserved under copyright, trademark law, design and model law, and/or any other intellectual property right.
